Comments and Representations in regard to "Development Scheme"

If a project is being implemented by way of a "development scheme", the draft development scheme plan (DSP) of the project will be submitted to Town Planning Board. The TPB will publish the draft DSP for public inspection. Any comment of the draft DSP can be made to the Town Planning Board (TPB) during the public inspection period. The TPB will consider the draft DSP of the project and the comments received.

If the TPB considers the draft DSP suitable for publication under the Town Planning Ordinance (TPO), the TPB will exhibit the draft DSP for public inspection. Any person can make representations in respect to the draft DSP to the TPB during the public inspection period (TPB PG-No. 29A). The TPB will conduct hearings to the representations.


Comments and Objections in regard to "Development Project"

If a project is being implemented by way of a "development project", comments and objections can be made to the URA within two months from the date of the publication in the Gazette notice of the project (“the publication period”). The URA will deliberate on the objections and submit its deliberations together with the development project, any objections not withdrawn and related assessment to the Secretary for Development (SDEV) not later than 3 months after the expiration of the publication period. The SDEV will consider the development project and any objections which are not withdrawn and can decide to: authorize the URA to proceed with the development project without any amendment; make an amendment to the development project to meet an objection; or decline to authorize the development project.

An aggrieved objector to the decision of SDEV, can appeal to an independent Appeal Board panel appointed by the Chief Executive of the HKSAR. After the hearing of an appeal, the Appeal Board shall publish in the Gazette notice its decision.

For objections in regard to projects to be implemented by way of development project, people can submit them to the URA (Guidelines on Submission of Objections to Projects to be Implemented by Way of Development Project) using Submission Form No. S24.

For general comments (including support) in regard to projects to be implemented by way of development project, people can submit them to the URA using Submission Form No. S24.

All submissions, whether comments or objections, should be sent during the 2-month publication period for development projects under the Urban Renewal Authority.
